Membership Agreement
1. Parties
a) Black Group Tekstil Ticaret Limited Şirketi, residing at Beşiktaş/İstanbul, operating the www.blackfashion.com.tr website (hereinafter referred to as Black Fashion).

b) The internet user who is a member of the www.blackfashion.com.tr website.
2. Subject of the Agreement
The subject of this agreement is to determine the terms of use for the member to benefit from the www.blackfashion.com.tr website owned by Black Fashion. To establish this membership agreement, it is sufficient to enter the requested membership information and the password you will determine, and complete your membership by providing the specified approvals and/or permissions. We kindly ask you to enter your name, email address/mobile phone number, and other mandatory information correctly, completely, and without errors; please correct any errors you notice. After completing the membership process, you can correct any missing/erroneous information you notice in the "My Account" section, which you can access from the member login area, or you can contact our customer service at +90 850 888 88 23.
3. Rights and Obligations of the Parties
3.1 The Member declares and undertakes that the personal and other information provided when becoming a member of the Black Fashion website is true before the law, and that www.blackfashion.com.tr will compensate for all damages incurred due to the inaccuracy of this information, in full and immediately.
3.2 The Member cannot give the password provided by Black Fashion to other persons or organizations; the right to use the said password belongs exclusively to the member. For this reason, Black Fashion reserves all rights to compensation and other claims against all responsibilities that may arise and against all claims and demands that may be put forward against www.blackfashion.com.tr by third parties or authorized authorities due to the unauthorized use of the said password.
3.3 The Member accepts and undertakes in advance to comply with legal regulations and not to violate them while using the Black Fashion website. Otherwise, all legal and criminal liabilities will be entirely and exclusively binding on the member.
3.4 The Member cannot use the Black Fashion website in any way that disrupts public order, is contrary to general morals, annoys and harasses others, for an unlawful purpose, or in a way that infringes on the intellectual and copyright of others. In addition, the member cannot engage in activities (spam, virus, Trojan horse, etc.) and actions that prevent or make it difficult for others to use the services.
3.5 The ideas and thoughts declared, written, and used by members on the Black Fashion website are entirely the personal views of the members and are binding on the opinion holder. These views and thoughts have no connection or relevance to www.blackfashion.com.tr. Black Fashion has no responsibility for damages that third parties may suffer due to the ideas and views declared by the member, and for damages that the member may suffer due to the ideas and views declared by third parties.
3.6 Black Fashion will not be responsible for unauthorized reading of member data and for damages that may occur to member software and data. The Member has accepted in advance not to claim compensation from Black Fashion for any damages that may be incurred due to the use of the Black Fashion website.
3.7 The Member has accepted not to access or use the software and data of other internet users without authorization. Otherwise, the legal and criminal responsibilities arising therefrom belong entirely to the member.
3.8 The member who violates one or more of the articles listed in this membership agreement will be personally responsible criminally and legally for this violation, and www.blackfashion.com.tr will be held harmless from the legal and criminal consequences of these violations. In addition; in the event of this violation being referred to the legal field, Black Fashion reserves the right to claim compensation from the member for non-compliance with the membership agreement.
3.9 Black Fashion always has the right to unilaterally delete the membership of the member, and delete files, documents, and information belonging to the customer, when necessary, without prior notice and/or warning. The member accepts this disposition in advance. In this case, Black Fashion has no responsibility.
3.10 The software and design of the Black Fashion website are the property of Black Fashion, and the copyright and/or other intellectual property rights related to them are protected by relevant laws, and these cannot be used, acquired, or changed by the member without authorization. Other companies and their products mentioned on this website are trademarks of their owners and are also protected under intellectual property rights.
3.11 Black Fashion may collect certain information such as the name of the internet service provider and internet protocol (IP) address used to access the site, the date and time of access, the pages accessed while on the site, and the internet address of the website that directly provides access to the site, for the purpose of improving and developing the www.blackfashion.com.tr website and/or within the framework of legal regulations.
3.12 Black Fashion may disclose the member's personal information when required by law, or when it believes in good faith that it is necessary to act in accordance with legal requirements or to comply with legal processes communicated to www.blackfashion.com.tr; to protect and defend the rights and property of the Black Fashion website family.
3.13 Black Fashion has taken measures within the scope of available possibilities to ensure that the Black Fashion website is free from viruses and similar malicious software. In addition, to ensure final security, the user must provide their own virus protection system and ensure the necessary protection. In this context, by entering the Black Fashion website, the member is deemed to have accepted that they are responsible for all errors that may occur in their software and operating systems and their direct or indirect consequences.
3.14 Black Fashion reserves the right to change the content of the Black Fashion website at any time, to change or terminate any service provided to users, or to delete user information and data registered on the Black Fashion website.
3.15 Black Fashion may change, update, or cancel the terms of the membership agreement at any time without any prior notice and/or warning. Every provision that is changed, updated, or repealed will be effective for all members as of the date of publication.
3.16 The parties accept and declare that all computer records of Black Fashion will be taken as the sole and exclusive evidence, and that the said records constitute a contract of evidence.
3.17 Black Fashion, in accordance with this membership agreement, has the authority to send informational emails to the electronic mail addresses registered with it and informational SMS messages to their mobile phones; by approving this membership agreement, the member will be deemed to have accepted the sending of informational emails to their electronic mail address and informational SMS messages to their mobile phone.
3.18. For your use of our site, all credit card transactions and approvals are carried out online between you and the relevant bank and similar card organizations independently of our company. Members are personally responsible for any issues that may arise during payment, such as phishing attacks. Our company will not display any data screen, including the member's bank information and password, and will connect to secure payment platforms provided by banks.
3.19 The security and usage terms published on our website are valid; our Company is not responsible for any disputes, material or moral damages and losses that may arise from information usage from websites reached for advertising, banners, content, or any other purpose, from all kinds of notifications received from them, and from mobile applications, as well as due to their ethical principles, privacy-security principles, personal data storage and destruction policies, service quality, terms of use, and other applications.
3.20 For your purchases from our site, the order pre-information form - distance sales contract terms that you will see during each transaction will also be valid.
4. Termination of the Agreement
This agreement will remain in force until the member cancels their membership or their membership is canceled by Black Fashion. Black Fashion may unilaterally terminate the agreement by canceling the member's membership if the member violates any provision of the membership agreement.
5. Resolution of Disputes
We are pleased to address the rightful requests and complaints of our members, as well as all kinds of applications. If it is not possible, you can apply to the Provincial and District Arbitration Committees and Consumer Courts in your place of residence, within the legal monetary limits. Istanbul Courts and Enforcement Offices are authorized in disputes related to this agreement.
6. Effectiveness
This agreement becomes effective upon the member's complete completion of membership procedures.
